Complaint Procedures

A member of the public may submit a complaint form or letter of complaint to the Alabama Real Estate Commission by mail (1201 Carmichael Way, Montgomery, AL 36106) or fax (334.270.9118) and it will be assigned to an investigator. The complaint form or letter should include who, what, where and when the incident(s) took place upon which the complaint is based. The complainant should also enclose any contracts or other documents that would be pertinent to show what happened. After the matter is investigated, the Alabama Real Estate Commission RULE 790-X-3-.06 prevails:

The investigator to whom a particular matter is assigned, in consultation with the Attorney General or his representative, shall determine whether probable cause exists regarding that matter for filing a Formal Complaint and/or holding a hearing for the refusal, suspension or revocation of a license or the fining or reprimanding of a licensee.

If sufficient probable cause is found, a Formal Complaint is drafted and "Scheduled for Hearing" before the Commissioners who are appointed by the Governor of Alabama.

Instructions

This form may be used by a person desiring to file a complaint against any party or company when it is believed that the person or company may have violated the Alabama Real Estate License Law [Chapter 27 of Title 34 of the Code of Alabama 1975, as amended] or the Rules and Regulations of the Alabama Real Estate Commission. When received by the Real Estate Commission, the completed form will be turned over to the investigative staff of the Commission. Their report will go to the Commission’s legal counsel for a determination as to whether action should be taken against the person or company. Please complete this form accurately, and submit to the Commission.
